THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT, CLASS ACTION WAIVER, AND JURY TRIAL WAIVER THAT AFFECT YOUR RIGHTS. IN ARBITRATION, THERE IS NO JUDGE OR JURY AND LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT. PLEASE CAREFULLY REVIEW THE DISPUTE RESOLUTION SECTION BELOW.

AmericaKORS (“we,” “us,” “our”) offers an optional mobile messaging and AI phone call program (the “Program”), subject to these Mobile Messaging Terms and Conditions (the “Terms”).

By providing your mobile number and opting in, you consent to receive calls and texts, including auto-dialed and automated calls and texts, from AmericaKORS. Acceptance by You

BY OPTING INTO THE PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE WITH THESE TERMS OR WISH TO STOP PARTICIPATING IN THE PROGRAM, YOU MAY OPT-OUT AT ANY TIME BY REPLYING “STOP” TO ANY MOBILE MESSAGE OR REQUESTING TO STOP AI PHONE CALLS.

User Opt-In

The Program allows users to receive SMS/MMS mobile messages and AI phone calls from AmericaKORS. By opting in, you agree that these Terms will govern your participation. YOU AUTHORIZE US TO USE AUTODIALER OR NON-AUTODIALER TECHNOLOGY TO SEND TEXT MESSAGES OR MAKE AI-ASSISTED PHONE CALLS TO THE NUMBER ASSOCIATED WITH YOUR OPT-IN.

Program Description

Users that opt into the Program can expect to receive communications regarding environmental news, updates on conservation efforts, donation information, and messages about AmericaKORS’s activities.

Cost and Frequency

Message and data rates may apply. The Program involves recurring mobile messages and AI phone calls, with the number of messages varying based on user interaction.

MMS Disclosure

If your mobile device does not support MMS messaging, the Program will send SMS MTs (Mobile Terminated Messages).

Our Warranty

We are not responsible for any delays or failures in receiving messages or calls as delivery is subject to your wireless service provider/network operator, which is outside of our control. We are not liable for delayed or undelivered mobile messages.

Privacy Policy

We respect your privacy. By opting into the Program or sharing your personal information, you consent to the handling of your information as outlined in our Privacy Policy, available at https://americakors.com/privacy-policy/.

Dispute Resolution

In the event of a dispute or claim between you and us, including any third-party service provider acting on our behalf, arising out of or relating to these Terms, the Program, or our Privacy Policy, the dispute will be resolved through arbitration in [Placeholder for Jurisdiction], before one arbitrator. The arbitration will be administered by JAMS, and the substantive law of [Placeholder for State] will apply. For claims under $250,000, JAMS Streamlined Arbitration Rules will apply. For claims over $250,000, JAMS Comprehensive Arbitration Rules will apply. The arbitrator’s decision will be final and binding.

To the fullest extent permitted by law, all claims will be resolved on an individual basis and not as part of a class, consolidated, or representative action. You also waive the right to a trial by jury.

Miscellaneous

You warrant that you have all necessary rights to agree to these Terms and that you are not breaching any other contract by participating in this Program. Failure to exercise any right hereunder does not constitute a waiver of any rights. If any provision of these Terms is found to be unenforceable, it will be limited to the minimum extent necessary, and the remaining Terms will remain in full force.

We reserve the right to modify these Terms at any time. Changes will be communicated to you and it is your responsibility to review them. By continuing to participate in the Program after changes are made, you accept the revised Terms.

Contributions to AmericaKORS are tax-deductible to the fullest extent allowed by law. As a registered 501(c)(3) nonprofit charitable organization, we comply with all federal and state regulations concerning nonprofit donations.

By making a donation, you affirm that:

• I am a U.S. citizen or permanent resident, or I represent a U.S.-chartered corporation with funds derived from U.S. revenues.
• This donation is made from my own funds or the funds of the organization I represent and has not been reimbursed by another entity.
• This donation is not made by a foreign national or from the treasury of a federal government contractor.

AmericaKORS operates independently and is not affiliated with any political party or candidate. As a 501(c)(3) organization, we are prohibited from participating in any political campaign activities. 

IRS

Federal law requires donors to maintain records of their contributions. For any single contribution of $250 or more, donors must obtain a written acknowledgment from the charitable organization to claim a deduction.
